Hershey Triumphs in Lawsuit Over Halloween-Themed Reese’s Candy
Recently, Hershey emerged victorious in a class action lawsuit that accused the company of misleading customers who purchased Halloween-themed Reese’s candy. The lawsuit claimed that the spooky designs featured on the packaging were not reflected in the actual candies.
A federal judge dismissed the complaint last week, ruling that the customers did not suffer any real harm as a result of their purchase.
The lawsuit, filed in southern Florida last year, alleged that consumers were deceived by the packaging of pumpkin- and ghost-shaped candies that showcased intricate designs. When the customers discovered that the candies were plain, they felt cheated and misled.
However, Hershey argued that the plaintiffs did not experience any financial loss since they still received the delicious Reese’s candy they paid for. The company pointed out that the packaging also included images of the uncarved designs and a disclaimer regarding the artistic renderings.
The initial lawsuit sought damages of at least $5 million.
Anthony Russo, the attorney representing the plaintiffs, clarified that the court’s decision was procedural and not a reflection of the case’s merits. He reassured that steps would be taken to ensure transparent and accurate labeling in the future.
On the other hand, Hershey did not provide any immediate comment on the matter.
Despite this legal battle, Hershey introduced a range of new Halloween products this year, such as miniature Reese’s in collaboration with Peanuts’ “It’s the Great Pumpkin Charlie Brown,” vampire-shaped Kit Kats, and ghost-shaped Twizzlers.
Earlier in the year, Hershey announced a double-digit increase in candy prices due to the rising cost of cocoa. The company reported a 26% year-over-year growth in consolidated net sales, fueled by early shipments of Halloween candy and the growing trend of “summer-ween.”
